Terms of Service

LaunchKit is operated by Rylan Cantu, a sole proprietorship based in Farragut, Tennessee.

1. Acceptance of Terms

By creating an account, purchasing a Business Kit or Logo Kit, or otherwise using LaunchKit (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if that is older, to create an account or purchase any part of the Service. By using LaunchKit, you confirm that you meet this requirement.

3. Description of Service

LaunchKit offers two kinds of digital product. No physical products are shipped.

Business Kits are hosted websites you configure through our setup dashboard. Business Kits run exclusively on LaunchKit’s infrastructure and are billed as a recurring monthly subscription.

Logo Kits are a one-time purchase of downloadable logo files and brand assets, with no recurring billing.

4. Accounts

You need an account to purchase or use the Service. You’re responsible for keeping your login credentials secure and for all activity under your account.

5. Intellectual Property

LaunchKit owns all software, website templates, designs, branding, graphics, source code, dashboards, documentation, logos, business kit layouts, UI/UX, and other content that make up the Service (collectively, “LaunchKit Assets”). Purchasing a kit or subscribing to the Service gives you a limited license to use LaunchKit Assets as described in these Terms — it does not transfer ownership of any LaunchKit Assets to you.

6. Hosted Website Restrictions

Business Kits are licensed for use only through LaunchKit’s hosting — a Business Kit is not a product you take elsewhere. You may not:

  • export your hosted website or download its source code
  • copy or reuse LaunchKit templates, layouts, or designs outside the Service
  • migrate a Business Kit to another host
  • clone, reproduce, or recreate the Service or any part of it
  • reverse engineer, decompile, or attempt to extract the source code of the platform
  • scrape the platform or its content
  • bypass or attempt to bypass any technical restriction of the Service

Your hosted website remains LaunchKit property. You own only the content you upload to it (see Section 7).

7. Your Content

You retain ownership of the text, business information, photos, and logos you upload while setting up your site (“Your Content”). You grant LaunchKit a limited license to store, display, process, transmit, and host Your Content solely to operate and provide the Service to you. You’re responsible for making sure you have the rights to anything you upload.

8. Purchases and Payment

Payments are processed by Stripe. Business Kits are billed as a recurring monthly subscription — by subscribing, you authorize us (via Stripe) to charge your payment method the listed monthly price on each billing cycle until you cancel. Logo Kits are a single one-time charge with no recurring billing. Prices are shown in U.S. dollars unless otherwise stated.

9. Subscription Changes

We may change subscription pricing, modify plans, or discontinue features over time. If a price increase affects your active subscription, we’ll give you reasonable advance notice before it takes effect.

10. Refund Policy

We offer a 14-day money-back guarantee on your initial payment — the first month’s charge for a Business Kit subscription, or the purchase price for a Logo Kit. This guarantee applies once, to your original purchase; subscription renewals are non-refundable except where required by law. To request a refund, contact support with your order details; refunds go to your original payment method and may take 5–10 business days to appear.

Refund eligibility ends once a Business Kit has been connected to a custom domain, or once the 14-day window has passed, whichever comes first.

11. Chargebacks

We may suspend or terminate any account involved in a fraudulent chargeback or other payment abuse.

12. No Professional Advice

LaunchKit provides website templates and educational materials only. Nothing we provide constitutes legal, accounting, tax, financial, or business consulting advice. You’re responsible for reviewing any materials or content before relying on them for your business.

13. No Business Guarantees

We don’t guarantee any particular business outcome — including income, profits, search-engine rankings, customer acquisition, or compliance with any law or regulation that applies to your business. Your results depend on factors outside our control.

14. Availability

We don’t guarantee uninterrupted access to the Service. Maintenance, outages, internet failures, third-party provider issues, and events outside our control (see Section 22, Force Majeure) may temporarily interrupt the Service.

15. Third-Party Services

LaunchKit relies on third-party providers to operate the Service, which may include payment processors, hosting providers, domain registrars, analytics providers, AI providers, and affiliate programs, among others. We’re not responsible for outages, errors, or actions taken by these third parties.

16. Affiliate Links

LaunchKit may include affiliate links. If you make a purchase through one, we may earn a commission at no extra cost to you. We’re not responsible for the products or services sold by third parties through those links.

17. Prohibited Uses and License Restrictions

In addition to the restrictions in Section 6, you may not use the Service to:

  • publish unlawful, infringing, or fraudulent content
  • impersonate another business or person
  • disrupt or attempt to gain unauthorized access to the Service

You also may not:

  • resell, redistribute, or sublicense a kit or any LaunchKit Asset
  • claim a LaunchKit Asset as your own work
  • remove or alter any copyright or proprietary notice from a LaunchKit Asset
  • use LaunchKit Assets to build or launch a competing template or website-kit marketplace

18. Data Retention and Cancellation

If you cancel a Business Kit subscription, your hosted website is disabled once your current billing period ends. We retain your account and site data for a reasonable period after cancellation in case you resubscribe, but it isn’t kept indefinitely — we may permanently delete it after that period. You’re responsible for backing up any content you want to keep before you cancel.

19. Termination

We may suspend or terminate your access to the Service for violating these Terms. You can stop using the Service at any time. A Business Kit does not remain hosted indefinitely after cancellation — see Section 18 for what happens to your site and data.

20. Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. To the fullest extent permitted by law, LaunchKit and its owner are not liable for indirect, incidental, special, or consequential damages — including lost profits, lost business opportunities, loss of data, or loss of goodwill — arising from your use of the Service.

To the fullest extent permitted by law, LaunchKit’s total liability for any claim arising from these Terms or the Service is limited to the total amount you paid to LaunchKit in the twelve (12) months before the claim arose.

21. Indemnification

You agree to indemnify and hold harmless LaunchKit and its owner from any claim, loss, or expense (including reasonable legal fees) arising from Your Content, your unlawful use of the Service, your misuse of the Service, or your violation of these Terms.

22. Force Majeure

LaunchKit is not liable for any delay or failure to perform caused by events outside our reasonable control, including natural disasters, acts of government, labor disputes, internet or infrastructure failures, or failures of our third-party providers.

23. Assignment and Transfer of Business

We may assign or transfer these Terms, your account, and our rights and obligations under this Agreement without your consent — including in connection with a merger, acquisition, reorganization, or a sale of all or substantially all of the business or its assets. If that happens, the new owner will be bound by these Terms, and we’ll provide notice of any material change in who operates the Service. You may not assign or transfer your own rights or obligations under these Terms without our prior written consent.

24. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Service will be brought exclusively in the state or federal courts located in Knox County, Tennessee, and you consent to personal jurisdiction there.

25. Miscellaneous

Severability. If any part of these Terms is found unenforceable, the rest remains in effect.

Entire Agreement. These Terms are the entire agreement between you and LaunchKit regarding the Service, and supersede any prior agreements on the same subject.

Waiver.If we don’t enforce a provision of these Terms, that’s not a waiver of our right to enforce it later.

Electronic Communications. By using the Service, you consent to receive communications from us electronically, including by email or through the dashboard.

Survival. Sections that by their nature should survive termination — including Intellectual Property, Hosted Website Restrictions, Your Content, Disclaimers and Limitation of Liability, Indemnification, and Governing Law — remain in effect after your account is terminated or these Terms otherwise end.

26. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
